Surrender and regrant of Agricultural Holdings Act 1986 Act tenancies

Following recent reforms it is now possible for a tenant to surrender an old style Agricultural Holdings Act tenancy in exchange for a new tenancy on identical terms with the same security. This is advantageous for a landlord as any tenancy of agricultural property granted after 1995 attracts 100% relief from inheritance tax rather than 50% relief  for tenancies granted before 1995.

There can be tax considerations with a surrender and regrant and our team is able to provide specialist advice.
